Welcome to SMP Bullion & Diamonds. These Terms and Conditions govern your use of the SMP Bullion & Diamonds website (https://smpbullionanddiamonds.co.uk/), our physical showroom services, and the purchase or sale of precious metals, bullion, and jewellery.

By accessing this website, using our services, or engaging in a transaction with us, you agree to be bound by these Terms and Conditions.

2. Services Provided

SMP Bullion & Diamonds provides the following services:

• Buying scrap gold, silver, platinum, palladium, and jewellery.
• Selling gold and silver bullion (including LBMA-certified Metalor and Umicore products).
• Transparent melting services.
• Processing lemels and sweeps.
• Selling diamond and gold jewellery (retail and wholesale/trade).
• Bar manufacturing.

3. Purchasing Bullion and Jewellery (Buying from Us)

• Live Pricing: Precious metal prices fluctuate constantly. The prices of bullion and grain are based on the live market price at the moment you agree to purchase. Once an order is confirmed, the price is fixed, and you are legally bound to complete the transaction.
• Order Acceptance: We reserve the right to refuse any order or cancel a transaction if there is an error in pricing or inventory, or if we suspect fraudulent activity.
• Payment: Full payment must be received in cleared funds before goods are dispatched or released for collection. Accepted payment methods include [Insert Payment Methods, e.g., Bank Transfer, Debit Card]. Cash limits may apply in compliance with UK anti-money laundering regulations.
• Delivery & Insurance: Goods are dispatched using fully insured, tracked delivery methods. The risk of loss passes to you once the goods are signed for at the delivery address.

4. Selling Scrap and Precious Metals (Selling to Us)

• Valuation and Testing: When you send or bring us scrap jewellery or precious metals, we will test the purity using XRF technology. Our valuation is based on the live scrap price and the actual pure metal content, which may differ from hallmarks or your own estimates.
• Seller Packs (Postal Service): Items sent via our Free Seller Pack are insured up to £2500 using standard Royal Mail Special Delivery, provided you follow our packaging instructions.
• Offer and Acceptance: Once tested, we will present you with an offer. You have the right to accept or decline. If accepted, payment is typically processed within 24 hours. If declined, we will return your items to you via insured post.
• Ownership: By sending or handing over items to us, you warrant that you are the legal owner of the items and have the legal right to sell them.

5. Identification and Anti-Money Laundering (AML)

As a dealer in precious metals, SMP Bullion & Diamonds is strictly regulated by HMRC for Anti-Money Laundering (AML).

• We may require photographic ID (e.g., Passport, Driving Licence) and proof of address for transactions over certain thresholds.
• We reserve the right to withhold payment or refuse service if appropriate identification is not provided or if a transaction triggers our AML safeguards.

6. Trade Customers (B2B)

• If you apply for and are accepted as a "Trade Customer," separate wholesale pricing and bespoke manufacturing terms will apply.
• B2B transactions are exempt from standard consumer distance-selling regulations (see Section 7).

7. Returns and Cancellations

• Bullion and Precious Metals Exemption: Under the UK Consumer Contracts Regulations, the 14-day right to cancel a distance contract does not apply to the supply of goods whose price is dependent on fluctuations in the financial market which cannot be controlled by the trader (e.g., gold and silver bullion, grain, and scrap sales). All sales and purchases of precious metals are final once the price is agreed.
• Jewellery Returns: For non-bullion retail jewellery purchases, please refer to our dedicated Refund & Returns Policy for information on eligibility, timeframes, and conditions for returning items.
• Defective Goods: If you receive goods that are damaged or significantly not as described, you must notify us within [e.g., 48 hours] of receipt.

8. Limitation of Liability

To the maximum extent permitted by UK law:

• We are not liable for market fluctuations that alter the value of your goods or investments.
• We shall not be liable for any indirect, consequential, or special losses, including loss of profit or business interruption.
• Our total liability in respect of any order or transaction shall not exceed the total price paid or offered for the goods in question.

9. Privacy and Data Protection

We process your personal information securely and strictly in accordance with our Privacy Policy and UK GDPR regulations.

10. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes relating to these terms will be subject to the exclusive jurisdiction of the courts of England and Wales.
